Tenancy Deposit Schemes

Unprotected Deposits

Residential Landlords have a legal obligation to pay any deposits received from Tenants into a Tenancy Deposit Scheme (also known as TDS). Unfortunately, a considerable number of deposits in the UK are not protected appropriately, leaving Landlords to face legal implications.

If you have paid a tenancy deposit to a Landlord for an assured shorthold tenancy, and the Landlord failed to protect your deposit by an approved TDP scheme or did not comply with the tenancy deposit protection scheme rules, you can make a claim.

You can apply for a court order to ensure that your deposit is protected or returned to you. You may also be eligible to be paid a statutory penalty of up to 3 times the value of your deposit.

At Brain Picker, we offer legal help with tenancy deposit claims and disputes between Landlords and Tenants. If you are not sure whether your tenancy deposit has been protected, we can check that for you. If it hasn’t, we can pursue your landlord for compensation. It is important to keep in mind that you have up to 6 years to claim your compensation, and the Court must award you between 1-3 times the amount of the deposit in compensation.

Our team can guide you through your claim from start to finish. We represent clients nationwide with an expert service offered on a no-win-no-fee basis.
